Legal action for an employer not verifying employment?

I understand that there is not specific legal statute against an employer who refuses to verify your employment, but if you were offered a job (orally), your background check came back clean and the only thing pending is for your former employer to response and verify employment, but they refuse to (boss won’t even return your emails/calls) mainly becuase you decided to leave his company and pursue a more satisfying career; can you legally sue your boss if your prospective employer takes back your oral job offer?

Pay stubs are not valid to verify employment.

    there is nothing that can make an employer provide a reference , that fact alone should be a killer

    It seems to me that paycheck stubs would be proof.
