Can I get unemployment if laid off and boss offers me a new job at a separate company he owns?

My boss owns two businesses. The one I work for is closing, which would grant me unemployment. He wants to offer me a job at his SECOND business knowing full well that I cannot work there (distance issues, under the table pay, and 60+ hours a week with no overtime). If I refuse the job offer, can I still collect unemployment? I feel like he’s offering me this job specifically to keep me from getting unemployment, as he knows I cannot work it.

    has he been paying you under teh table at your current job?

    if yes, then that means he has NOT been paying into the unemployment system for you and depending on how long you have worked there – you probably will NOT get unemployment benefits at all

    if he IS paying you normally now and you got a w-2 from him for 2009, then you can probably turn down the under-the table job and not lose UC benefits, especially if new job is a long commute compared to what you do now – he may appeal and you will have to explain his illegitimate offer to you
